COMAIR Regional Airlines Case Study Example | Topics and Well Written Essays - 2500 words
COMAIR Regional Airlines - Case Study Example The regional airline COMAIR, a subsidiary of Delta Air Lines, which serves routes in the United States, Canada and Europe is poised to become very competitive and profitable in 2010. COMAIR currently has 5,800 dedicated aviation professionals and services 511 daily flights to about 77 international and domestic destinations. The COMAIR is the preferred airline of choice by most business travellers and frequent travellers as it offers affordable airfares. COMAIR has gone from strength to strength by rapidly rolling out international routes and additional services for the customers. Another important cost factor for regional airlines is the national and local taxes imposed by the US government. Most countries treat airlines like cash cows by levying national prerogatives and taxes on them that results in higher costs of doing business. Another positive trend is that inspite of the US recession, the regional airlines do offer the safest form of transportation. Although US airlines carry 3.5 million passengers annually, the accident rate is very low compared to the accident rates of motor vehicles and maritime vessels. Another interesting and positive development is that air travel has improved its safety record over time. New US airline jets have more safeguards and safety measures which help minimize untoward accidents on air and on the ground. Among the interesting market players in the US airlines industry is COMAIR. For instance, COMAIR has been effective in four general areas of operations: 1) winning customers; 2) maintaining its fleet in excellent condition; 3) close relations with its pool of human resources, 4) keeping its finances viable. In general, COMAIR's is able to grow its equity over time (McCabe, 1998)COMAIR has increased international capacity by 15 percent in 2008 to address increasing demand. (International Herald Tribune, June 4, 2008) The company has consistently upgraded its fleet on a yearly basis. As regards its salary expenses, Comair's flight attendants have approved a US$7.9 million dollars in wage cuts intended to help the company recover from its financial difficulties. Fourth, COMAIR has been able to manage its finances well. The company has managed to keep unit revenues up and unit costs down. The airlines fly all their available seats, hence, the company managers try to increase their unit revenues on a quarterly basis. The COMAIR managers understand that most of the airline's costs are fixed. Approximately ten percent of costs go to services such as airport fees and air navigation services fees. Labor costs take up an average of 38 percent in the United States. Hence, the COMAIR managers have focused on decreasing the unit cost to bring down operations cost.In addition, the managers continue to manage near-term liquidity pressures. Cash collateral posting requirements had a material impact on its unrestricted cash positions since 2008. Delta Air Lines, stated on Dec. 2, 2008 that its projected cash collateral posting requirement at Dec. 31, 2008 would be approximately US $1.1 billion dollars. In response to the situation of the parent company, C OMAIR is focused on improvements in free cash flow as the key to liquidity preservation. In addition, the company has scaled-back aircraft financing commitments and has

Realist and Feminist Structures in Perkins Gilman's The Yellow Essay
Realist and Feminist Structures in Perkins Gilman's The Yellow Wallpaper and Kate Chopin's The Storm - Essay Example Another similarity is the use of naturalist devices to construct both stories. Each story depicts the life of a single female protagonist who is mired in realistic situations that the reader can easily relate to. In addition to these similarities, both stories carry overriding feminist ideas and critique which essentially form the bulwark of both stories. This paper will compare and contrast both stories based on these structural, thematic and literary devices. The development of climax in both stories is gradual, uses symbols and both stories tend to end as soon as the climax is achieved. Gilmanââ¬â¢s The Yellow Wallpaper depicts the protagonist as going mad over time as her husband John locks her up in her room. The author has chosen the yellow wallpaper as a symbol to reflect changing attitudes and mental state on the part of the protagonist. The yellow color itself is something that the protagonist tends to loathe from the first time she looks at it. As the story proceeds to i ts climax, the yellow wallpaper tends to indicate and enhance the climax. According to Gilman (Carnley 23): ââ¬Å"It is the strangest yellow, that wall-paper! It makes me think of all the yellow things I ever sawââ¬ânot beautiful ones like buttercups, but old foul, bad yellow things. But there is something else about that paperââ¬âthe smell!â⬠Again towards the end of the story (Carnley 26): ââ¬Å"For outside you have to creep on the ground, and everything is green instead of yellow.â⬠At the climax, the protagonist goes mad thinking that she just managed to extricate herself from the yellow wallpaper which signals and symbolizes the climax. The story ends immediately afterwards as the protagonistââ¬â¢s husband John enters the room and faints while the protagonist continues her mad movements across the room. This is comparable to Chopinââ¬â¢s The Storm where the author has used the storm as a symbol while she moves slowly towards the climax. The behavior of Calixta and Alcee tends to change as the storm develops gradually. At the start of the story, the author states (Gale 81): ââ¬Å"She stood there with Bobinot's coat in her hands, and the big rain drops began to fall.â⬠However, as the story is about to end the author expresses the character of the storm as (Gale 82): ââ¬Å"The growl of the thunder was distant and passing away.â⬠This indicates that the gentle rain at the start of the story developed into a large storm with thunder and lightning that subsided as the protagonists were done with their adulterous affair. What is noticeable is that the storyââ¬â¢s climax is symbolized by a storm and that the story tends to end as soon as the climax is achieved. The end is again abrupt much similar to Galminââ¬â¢s The Yellow Wallpaper. In addition to this similarity, both stories employ naturalist devices in order to develop the story. The characters and the imagery provided by either author are realist and the reader c an relate these characters and scenarios to common life with ease. The protagonist in Gilmanââ¬â¢s The Yellow Wallpaper is a common housewife while her husband is a physician and predictably they have a middle class background. The protagonistââ¬â¢s thoughts and emotions expressed in the story signify that she is an ordinary person like anyone else. The fastidious nature of the protagonistââ¬â¢s husband is also attributable to the trends of the time. In the late nineteenth century physicians were still discovering new methods of treatment and took their time to differentiate right treatment from wrong. The

The Impact of ââ¬ËScientific Idealââ¬â¢ on the Development of Political Science Essay Example for Free
The Impact of ââ¬ËScientific Idealââ¬â¢ on the Development of Political Science Essay Introduction The philosophy of history is a study on how the human history is supposed to be laid down in papers. There are several studies that are interconnected with the process of knowing how and what should history contain about the human past. Along with this, an important focus on how wide the philosophies on historical set up directly affect the developments in the present systems of political science is also being observed. Political Science as defined mainly refers to the study of political behavior of people making up the government of certain specific countries. These behaviors also include the scientific examination of the acquisition and the application of power in different forms of government practiced by respectively different countries as well. According to authors Dickerson and Flanagan in their book ââ¬Å"An Introduction to Government and Politics (2001), ââ¬Å"Political Science is a process of conflict resolution in which support is mobilized and maintained for collective projectsâ⬠. This naturally means that it is a way in which countries are able to formulate public projects de to the existence of authorities who have the power to give permission for such public projects. Other known writers and philosophers have different views towards the real meaning of the said study. As for Mao Zedong, Political Science is the study of politics wherein politics is defined as ââ¬Å"war without bloodshed while war is politics with bloodshedâ⬠(As cited by Slann, 2004). Another writer, Otto Van Bismarck says that Political Science is the art of politics, which is referred to as the art of the possible (As cited by Slann, 2004). To him, the said study makes impossible things to occur within the existence of the human government. Indeed, as many writers have different and at times even contrasting views regarding the study of politics which is Political Science, debates and other social issues behind the controversies of political philosophies. Among the issues concerned within the topic is the fact that the Philosophies of History sets clear points showing the connection of the ââ¬Ëscientific idealâ⬠studies and observations to the developments of Political Science itself. With the use of several literature readings and observation, an issue regarding the emergence of power within the history of human civilization shall be discussed in this paper. Along with this, some points of concern regarding the relationship between the scientific processes mostly called the ââ¬Ëscientific idealââ¬â¢ in putting down the historical past of the human civilization and the development of Political Science up until the present time shall also be tackled herein. Philosophy of History The philosophy of history is referred to as the branch of the study of philosophy focused on the eventual significance of human history to the present development of several aspects of living within the human society. Thus, this study includes political science within its scope. In the process of knowing the specific details of human history and its connection to the present existing systems in the human society, several questions are considered in performing the said study. First is the determination of the specific and proper unit used for the study of the human past. It mainly asks ââ¬Å"what possible unit should be mainly considered when history is presented to the readers of the present generation, the individual points, the cities or the sovereign territories, the development of civilization or culture, or everything else comprised within the details of the human past?â⬠Another question is concerning the broad patterns used in posting the human past in historical write-ups and literatures. The main question is ââ¬Å"are there any patterns of progress followed in the posting of history? The last point of concern of this study is the direction passed by historical accounts. The question on this matter of concern is ââ¬Å"what is the driving force of the progress in history?â⬠The questions mentioned above are mainly used to observe the different aspects of human society. Moreover, among the aspects to be considered as mentioned earlier is the connection of this process to the developments of Political Science. Consequently, many debates arise because of the fact that there are many theories concerning this matter. Some of the theories of power and politics shall be discussed in the paragraphs to follow. The Introduction of ââ¬ËPowerââ¬â¢ in the Human Society With the records written in the pages of history, it has been made clear that ever since the human civilization started to thrive in the face of the earth, leadership and power had already been a part of the humanââ¬â¢s everyday living. There had always been a need for people to have somebody stand up as their leader to instruct them of what they are supposed to do. Simple forms of governments have been formed in the earlier years of human existence to support the said need for leadership. On the other hand, many people too wanted to have the privilege of ruling their respective small communities. With this, there came to be the birth of simple politics. According to the analysis of Michel Foucault (1977) in the journal ââ¬Å"Politico-Historicalâ⬠discourse on ââ¬Å"Race Struggleâ⬠, politics began to thrive due to the fact that people wanted to become a part of the authoritative power who rules other people. Because of this, Foucault claims that social conflict based on ethnic groups, class struggle as well as social elements contributing to power began in the earlier human generations. Then, as years passed, the simple political set up in the human communities began to change. Some tribes or even certain individuals wanting power, already wanted the position of an official in a certain society already came up with different propagandas to get what they want. Indeed, the politics as defined by Mao Zedong earlier as ââ¬Ëwar without bloodshedââ¬â¢ began to be given birth during these times of political progression in the human civilization. Another analysis on Philosophical History by Foucault (1976) entitled ââ¬Å"Society Must be Defendedâ⬠says that politics all began with the race struggle. People began to take territories as well as claim their peopleââ¬â¢s race when the beginning of politics had been introduced to the human society. This has been proven when the said analysis of human society and politics by Foucault had been used in Great Britain for study. It has been proven that people used to struggle against monarchy thus having the motives of gaining considerable social class from not much different from that of the monarchial rulers. Indeed, as clearly pointed out on the different literatures regarding philosophy of history and how the human past accounts had been laid down into writing, politics had been proven as a developing social factor which directly affects the whole societyââ¬â¢s life and dealings with their own communities. Today, as history makes it clear, political science has been continuously developing through the years of human civilization. From the simple forms of government and creation of simple laws to the birth of a more organized human rulership and more complex creation of laws, the ââ¬Ëscientific idealââ¬â¢ had helped the people understand the developments of politics in the society as well as its study. Along the pages of human history, it could be tracked down how much politics as well as political science had been developing through the passing on of generations. The accounts on the years of imperialism and colonization have also been a factor, which contributed to the present political systems applied in many countries around the world. In this regard, the introduction of democratic government around the world had been very successful because of the fact that history shows the need for such kind of rulership basing from the past occurrences that happened due to the existence of other forms of government. Although not all the nations around the world applies the said form of government, many people still began to realize that this form of government gives so much benefit to people due to the effects of many analytical literatures written to support the said idea on freedom and democracy. Developments of Political Science As mentioned earlier, political science had been continuously developing through the years. Indeed, the fact that through the scientific formulas of historical presentation of different political accounts through the years of human civilization, politics and its study had been able to aim for better ways of governing people and helping the human civilization progress further for human advancement. In the face of history, it is clearly shown how the political aspect of the society had affected so much of human activities through the years of progress. Other social aspects such as religion and social classes as well as the different ideologies regarding life had been directly affected by the development of politics in the whole world. Along with this, the analysis of the said factor in human society also continuously developed helping in further progress of politics itself. As often said by writers who endeavor in the reports of both social and political progress, ââ¬Å"the society is constantly developing and this is all because of the impact of history to the human civilizationâ⬠(Rousseau, 2005). Conclusion True, as clearly pointed out in the entire theme of this paper, ââ¬Ëscientific idealââ¬â¢ in the placement of history of the human civilization on paper makes it possible for political science to develop in the way it analyzes the present political situations in the world. The creation of laws and other national rules are also directly affected by the said state of development in political science. Yes, indeed, the way history is carefully written for the benefit of the present generation is truly an important factor contributing to the progress of the study conducted by political science in the development of world politics and governance. Breach of Contract Example
Breach of Contract Example The purchase and sale agreement signed on August 1st 2014, between Insurance Depot Limited (Depot) and Mr. Sanford (Sanford), is a legally binding contract. As a result, Depot will be able to effectively enforce its contract with Sanford by taking legal action. Depots contract with Sanford satisfies the necessary elements of consideration, consensus, intention, legality, and capacity: Consensus There was a written agreement that was signed by both parties. This is proof of an offer and signed acceptance. Consideration Sanford sold his business for $1.4 million to Depot this is an exchange. Intent Intention is presumed in commercial transactions such as the sale or purchase of a business. Capacity and legality There is no evidence to suggest that either party lacked capacity, and both were represented by legal counsel. There were no signs of illegality in the contract. Because the contract satisfies all major elements outlined above, it is enforceable under the rules of contract law. What will be the likely result if they go to trial? If they go to trial, Depot must successfully demonstrate that Sanford breached at least one of the provisions of the contract. The contract outlines one major restrictive covenant: a non-competition clause. In this case, Depot can sue Sanford for breaching the non-competition provision of the purchase and sale agreement. The non-competition clause is legally enforceable as it is reasonable, and it does not contradict public policy. The clause is also clear and unambiguous. It is specific as it denotes the time frame of five years and geographical range of one hundred kilometres that prohibit Sanford from engaging in the business of insurance brokerage. In order for the clause to be enforceable, these constraints need to be considered reasonable. The geographic and time-based restrictions are assumed to be reasonable in this case. Sanford violated the non-competition clause by opening his new insurance brokerage only two blocks away from Depot. Sanfords breach of the non-competition clause effectively gives Depot the right to claim damages. In order to be entitled to a remedy, Depot must prove in a court of law that Sanfords breach of contract adversely affected Depots business profits. Depot could then be awarded financial compensation (pecuniary damages) for the lost potential business. In addition, Depot may also be entitled to the equitable remedy of an injunction on Sanfords new business. This would mean Sanford would have stop business operations until the five-year time span has elapsed, allowing Depot to establish itself as a major industry player in the area. In terms of solicitation, Sanford did not actively solicit customers these customers chose to switch to Sanfords new firm at their own will. If the contract did include a non-solicitation clause, Depot would likely be unsuccessful in taking legal action with regards to it.Ã Depot should focus its legal efforts solely on the breach of the non-competition clause. Should Depot sue with respect to the overstatement of accounts receivable? Although there was an overstatement of the accounts receivable on Sanfords financial statements, Depot should not sue for this misrepresentation. This is because Sanford innocently miscalculated the accounts receivable figures; it was not done in a fraudulent or negligent manner. While the statement was a misrepresentation given the fact that it was false, unambiguous, concerned with a fact, and material, it does not fully satisfy all of elements of actionable misrepresentation. As a result, Depot should not sue. In the case of innocent misrepresentation, the result is the remedy of rescission. This means that the contract would be cancelled, and both parties would return to their pre-contractual ownership positions. This is likely not in Depots best interest, as they have already owned the business for two years, and have thus invested a significant amount of time and money into the businesss development. Moreover, Depot has known about this error since approximately January 2015, and did not act upon it immediately. This reduces the likelihood of the remedy of rescission. Due to the innocent nature of the misrepresentation, and the fact that the only outcome is rescission, Depot should not pursue any legal remedy with regards to the misstated accounts receivable. What should Depot do? For the reasons outlined above, Depot should sue Sanford for breaching their contract, specifically the non-competition clause of it. The company is very likely to win a legal dispute against Sanford, and runs the risk of losing even more business to Sanford if they choose to remain passive. Going forward, Depot should hire a lawyer to represent them, and to examine precedent cases in order to evaluate the most appropriate course of legal action. Depot should also consider whether or not the financial compensation that may be awarded in a lawsuit will outweigh the direct and indirect costs involved in a lawsuit. Legal action is most likely worth Depots time and money in this case, as an injunction on Sanford would allow them to establish themselves in the insurance industry and create customer relationships without Sanfords competition for the remaining time frame of the covenant. In order to avoid losing more customers to Sanford, who has many connections and more experience in the local competitive landscape, Depot should pursue legal action immediately.

Cold War Essay -- essays research papers
After World War II, Stalin did not remove his troops from Eastern Europe as he pledged he would in the Yalta Agreement. Instead, he setup ââ¬Å"puppet governmentsâ⬠which did exactly as Mother Russia stated. To protect itââ¬â¢s interests for national security, the American Dream, and the belief that all people should have the right to a democratic life, complete with liberty, equality, and a representative government. Also playing a large part in Cold War tensions was the US interest in protecting its profitable foreign markets. The spread of communism challenged every one of these US aimââ¬â¢s, and therefore the US became convinced it had to stop this spread. The deliberate opposition to the spread of communism to capital countries is known as containment, which the US adopted in the late 1940ââ¬â¢s. The US believed it must do everything in its power to uphold containment and save itââ¬â¢s peoples way of life. Another theory that soon surfaced that was related to t he containment theory was the domino theory, which stated that as one small country fell to communism, surrounding small countries would also fall to communism rapidly. à à à à à In the spirit of containment, strongly supported by President Harry Truman, was the main driving force behind the Korean War. Along with containment as a force was American Pride. After World War II and after Japanese occupation, Soviet troops moved in to North Korea, and the US moved in to South Korea. Each setup and supported its own go...

Conradââ¬â¢s Congo Journey :: Biography Biographies Essays
Conradââ¬â¢s Congo Journey Joseph Conradââ¬â¢s own experiences during his trip through the Congo helped him provide a foundation for the writing of Heart of Darkness. In 1890, Conrad took a job as a captain on the river steamer Kinshasa. Before Conrad took this job, he had worked for the French merchant navy as a way to escape Russian military service and also to escape the emotional troubles that had plagued him. Conrad had been in a financial crisis that was resolved with help from his uncle. After this series of events, Conrad joined the British merchant navy at the beckoning of his uncle and took the job as the captain of a steamboat in the Congo River. An important fact to remember is that Conrad was a young and inexperienced man when he was exposed to the harsh and dangerous life of a sailor. His experiences in the West Indies and especially in the Belgium Congo were eye opening and facilitated his strong outlooks that are reflected in the book Heart of Darkness. Conradââ¬â¢s journey th rough the Belgian Congo gave him the experiences and knowledge to write about a place that most Europeans would never see in their lives. The diaries Conrad kept during his journey through the Congo gives detailed descriptions of the monotonous African landscape. Conrad wrote that the landscape of the African coast looked the same every single day.[1] This is reflected in Marlowââ¬â¢s narration of the jungle where shapes and forms cannot be made out clearly. The monotonous landscape differed from what Conrad had expected of this exotic location. When he was still a young kid, he had once boasted that he would someday journey to the heart of Africa. However, the actual journey was not at all what he expected it to be. Conrad was shocked at the men in the African colony. He was repulsed by the European colonizers because of the horrible treatment of the natives as well as the unlawful aggressive pursuit of loot. Conrad witnessed atrocities committed by the European colonizers, which helped to form his opinions on the colonization of Africa. In the novel, Conrad uses sarcasm to display his displeasure towar ds the European colonizersââ¬â¢ treatment of the natives. The Europeans in the book are called pilgrims and the natives are called cannibals, however the pilgrims are the ones who are much more willing to use force to resolve their problems.
